Participation
By participating in an auction on this site, you represent and warrant that you are of at least 18 years of age, and are fully able and competent to execute legally binding agreements, and take all actions required pursuant to the provisions contained herein.
Third Party Content
All references to third-party products, processes, services, logos, trademarks, and their respective owners, are solely nominative in purpose, and should in no way be construed as endorsement of any kind.
Condition and Future Availability of Listed Items
All listed items are provided 'as is, where is' and in conformance solely with the disclosed purposes, statements, descriptions, specifications, and images advertised on this site in relation to the specific listing.
Unless otherwise specified, no representation is made as to the availability of spare parts or repair facilities/services, for any item listed on this site.
Payments
All listings are denoted in Australian Dollars and are GST inclusive where applicable. Payments must be finalised within seven (7) days from winning notice, with notice issued automatically via email on close of auction. Failure to finalise payment within the allotted period will result in the cancellation of the bid. Repeated cancellations will result in exclusion from all future bidding.
All payments must be processed in person, on site, unless otherwise agreed – We accept cash, EFTPOS, and all major credit cards. Unless required by law, or otherwise permitted by provisions contained herein, all transactions are final and no exchanges or refunds will be permitted.
Reserved Auction Rights
The Town reserves the following rights in respect to all auctions conducted on this site:
- Shorten/Extend auction times
- Reschedule auctions
- Suspend/Cancel auctions/bids
First Preference
In the event of default, or cancellation, of the winning bid, the next highest bidder will be given first preference.
Limitation of Liability
Liability is limited, to the maximum extent permitted by law, and in the case of Consumer Rights, to the replacement of the goods, the supply of equivalent goods, the repair of such goods, or the payment of the costs of repair, or the payment of the costs for replacing the goods or suitable equivalent, or the partial or whole refund of original purchase.
The remedy provided will be at the Town's discretion, with any resulting payments limited to the value of the original transaction.
Jurisdiction
All auctions on this site, and associated procedures, processes, terms & conditions are governed by and construed in accordance with the laws of Western Australia, to which each party, non-exclusively, irrevocably submits in relation to any appeal.
Conflicting Provisions
In the event of any conflicting provisions, the advertised listing terms & conditions take precedence over the standard provisions contained herein.
Severability
If any provisions are held to be invalid, unenforceable, or otherwise illegal for any reason, the specified terms & conditions remain in full force and effect, apart from such provisions which will be read down to the extent of the invalidity, unenforceability or illegality, and if it is not possible to be read down, the provision will be deemed deleted.
Variations
The provisions contained herein were last updated on 01/07/2021.
We may, at our sole discretion, vary the terms & conditions at any time. However, unless otherwise advised, all listings will remain subject to the terms & conditions as advertised on the date of first publication – A copy of all superseded conditions can be obtained on request.
